The Race Equality Duty is a duty to take positive steps to eliminate discrimination, which falls to public authorities, within their jurisdiction, where the effect of their activities is likely to be discriminatory. The task of the Council will be to ensure that it and the Council-run bodies are able to comply with the Race Equality Duty. The Council’s Race Equality Duty will be to: promote fair opportunity for people from all backgrounds to participate equally in all aspects of life and employment; report annually on progress made towards eliminating discrimination against people from black, Asian and minority ethnic backgrounds; and make improvements and progress in this area where opportunities are available. Achievement of these goals will be assisted by: the Race Equality Duty; equality duty legislation and case law; the preparation of an annual equality strategy, supported by periodic monitoring of the strategy; government guidance and advice; analysis of the annual equality strategy and key deliverables; inspections and monitoring of the activities of the Council and its Council-run bodies. Scope of responsibility The Council will not be responsible for legislating in any area under its jurisdiction. Instead it will: operate on the basis that it is its duty to ensure that all of its Council-run bodies take positive steps to eliminate discrimination, where their activities are likely to be discriminatory. These are bodies such as: the Police; Central government; Council departments; Council-run schools; and Council-run social housing providers. The Council will not be responsible for: general criminal law and public order; regulations made by central government; other statutory bodies (including the Police); the activities of other local authorities; or the commercial world.
